Abstract Introduction: Native Forest resources, mainly in the Brazilian caatinga biome, are important for the subsistence of the rural population as well as for the local red ceramic and gypsum industry. Objective: To study the municipal disparity in the gross value of production of native timber products in Paraíba, Brazil. Materials and methods: Data on the gross value of production (GVP) of forest products (firewood, charcoal and roundwood) of the municipalities of Paraíba, Brazil, from 1994 to 2017 were used. This information is available from the Brazilian Institute of Geography and Statistics (IBGE). Location indicators (location and redistribution coefficients) and specialization indicators (specialization and restructuring coefficients) were used. Results and discussion: Firewood was the main timber product in the municipalities of Paraíba and there was a substitution effect between firewood and charcoal; the latter showed the best state redistribution and roundwood the lowest municipal production. The greatest specialization occurred in the municipality of Baía da Traição, represented by the exclusive production of charcoal. The municipalities of Tacima, Salgado de São Félix and Itapororoca showed greater restructuring, resulting from the change from charcoal to firewood production. Conclusions: Firewood is the most important product in the state of Paraíba, Brazil. This study becomes an important source of information for the use of this resource.

Resumen Introducción: Los recursos forestales nativos, principalmente en el bioma caatinga brasileño, son importantes para la subsistencia de la población rural como para la industria local de cerámica roja y yeso. Objetivo: Analizar la disparidad municipal en el valor bruto de producción de productos madereros nativos en Paraíba, Brasil. Materiales y métodos: Se utilizaron datos sobre el valor bruto de producción (VBP) de productos forestales (leña, carbón y madera en rollo) de los municipios de Paraíba, Brasil, de 1994 a 2017. Esta información está disponible en Instituto de Geografía y Estadística Brasileñas (IBGE). Se utilizaron indicadores de ubicación (coeficientes de ubicación y redistribución) y de especialización (coeficientes de especialización y de reestructuración). Resultados y discusión: La leña era el principal producto maderero en los municipios de Paraíba y existía un efecto de sustitución entre leña y carbón vegetal; este mostró la mejor redistribución estatal, y la madera en rollo, la menor producción municipal. La mayor especialización se dio en el municipio de Baía da Traição, representado por la producción exclusiva de carbón vegetal. Los municipios de Tacima, Salgado de São Félix e Itapororoca presentaron mayor reestructuración, debido al cambio de la producción de carbón vegetal a la de leña. Conclusiones: La leña es el producto más importante en el estado de Paraíba, Brasil. Este trabajo se convierte en una fuente importante de información para el uso del recurso maderero.

ABSTRACT The institution of biological value areas through the creation of Natural Protected Areas is an essential tool for protecting the country’s environmental resources to face advanced anthropic development in natural areas, either to increase agriculture production or for economic growth. Environmental vulnerability studies combined with geotechnological tools have been vital to identifying the most vulnerable areas and consequently help Conservation Units protection. This study aimed to analyze environmental vulnerability at the buffer zone of Itabira Natural Monument (MONAI) in Cachoeiro de Itapemirim, Brazil. The necessary methodological steps for this study were as follows: a) Photointerpretation of land use; b) Anthropic variables selection; c) Application of Euclidean distance function in variables vector images; d) Application of fuzzy membership function in variables raster images; e) Application of Analytical Hierarchical Process (AHP); and f) Spatial classification of environmental vulnerability around MONAI. Land use conflicts reveal a relevant presence of pasture areas, representing 49.80% of the buffer zone. This fact corroborates with its Euclidean distance value, which showed the lowest linear value, 836 meters. Eight anthropic variables have been incorporated, highlighting crops, urban areas, exposed soil and pasture. Jenks natural breaks defined five vulnerability classes. According to the results, 57.14% of the entire MONAI buffer zone is represented by the high and very high classes. The outdated law creation of MONAI and the need for a management plan result in a vulnerable buffer zone. The present study can support management plan formulation and assist MONAI’s buffer zone delimitation.

RESUMO A instituição de áreas de elevado valor biológico por meio da criação Unidades de Conservação (UC’s) tem se tornado importante instrumento de proteção aos recursos ambientais no país, frente ao desenfreado avanço antrópico sobre ambientes naturais. Os estudos de vulnerabilidade ambiental aliados à geotecnologia têm se mostrado uma relevante ferramenta na identificação de áreas mais vulneráveis, e, consequentemente, no gerenciamento e proteção das UC’s. Este trabalho objetivou analisar a vulnerabilidade ambiental no entorno do Monumento Natural do Itabira (MONAI), localizado no município de Cachoeiro de Itapemirim/ES, por meio de ferramentas geotecnológicas e inteligência artificial. As etapas metodológicas necessárias para este estudo foram: a) fotointerpretação do uso e ocupação da terra; b) seleção das variáveis antrópicas; c) aplicação da distância euclidiana nos vetores representativos das variáveis; d) aplicação da lógica Fuzzy nas matrizes das variáveis de distância euclidiana; e) aplicação do método Hierárquico Analítico (AHP); e f) espacialização das áreas de vulnerabilidade ambiental no entorno do MONAI. Os conflitos de uso e ocupação da terra demonstraram presença majoritária de pastagens, representando 49,80% da área de estudo, corroborando com o cálculo da distância euclidiana que atribuiu a esta variável o menor valor linear em relação à UC, 836 metros. Dentre as 5 classes de vulnerabilidade definidas pelas quebras naturais de Jenks, observou-se que 57,14% do entorno do MONAI é representado pelas classes alta e muito alta. A desatualização da lei de criação do MONAI e a inexistência de plano de manejo implicam no mapeamento de uma zona de amortecimento majoritariamente vulnerável ambientalmente. O presente estudo pode subsidiar a elaboração do plano de manejo e a demarcação da zona de amortecimento do MONAI.

RESUMO: Este artigo analisou a concentração regional da produção de lenha nativa do Rio Grande do Norte - Brasil, no período de 1990 a 2017. As informações da lenha nativa foram obtidas da produção da extração vegetal e da silvicultura, disponíveis no Instituto Brasileiro de Geografia e Estatística (IBGE). Analisou a conjuntura, a distribuição espacial da produção de lenha estadual por meio os quartis e mensurou a concentração por meio dos indicadores: Coeficiente de Gini (G), Índice de Concentração Compreensiva (CCI), Índice de Herfindahl-Hirschman (HHI) e Razão de Concentração [CR(k)]. Os resultados mostraram que houve decréscimo de -2,76% a.a. na produção de lenha nativa estadual, partindo de 5.280 x10³ m³ (1990) para 777 x10³ m³ (2017). O quartil municipal revelou que a maioria dos municípios produz pouca lenha; apesar do G ter inferido uma desigualdade muito forte a absoluta para os municípios produtores de lenha e fraca a nula para as mesorregiões, já o CCI mostrou para os municípios que é não concentrado e as mesorregiões tem concentração regional; HHI corroborou com esta afirmação mostrando um mercado altamente competitivo para os municípios e microrregiões e concentrado para as mesorregiões produtoras de lenha; o CR(k) dos quatro maiores municípios foi constatada uma concentração moderadamente baixa. Conclui-se que a lenha nativa do estado do Rio Grande do Norte possui estrutura de mercado competitiva.

ABSTRACT: This paperexamined the regional concentration of native fuelwood production in Rio Grande do Norte, Brazil, between 1990-2017. Information on native fuelwood was gathered fromforestry activitiescollected by the Brazilian Institute of Geography and Statistics (IBGE). This studyanalyzed the current situation and the spatial distribution of the state’s fuelwood production by quartiles. The following indicators were used to measure market concentration: Gini Coefficient (G), Comprehensive Concentration Index (CCI), Herfindahl-Hirschman Index (HHI) and Concentration Ratio [CR(k)]. In Rio Grande do Norte, there was a -2.76% annual decrease in the production of native fuelwood, from 5,280 x10³ m³ (1990) to 777 x10³ m³ (2017). Classification of the municipalities by quartile revealed that most municipalities had low fuelwood production. The G inferred a very strong to absolute inequality for the municipalities and a weak to null inequality for the mesoregions.The CCI demonstrated no market concentration in the municipalities and a regional concentration in the mesoregions. The HHI corroborated the CCI by affirming the presence of a competitive market for the municipalities and microregions and a concentrated market in the mesoregions.The CR(k) of the four largest municipalities indicated a moderately low concentration. This study concluded that there is a competitive market structure for native fuelwood inthe state of Rio Grande do Norte.

Resumo Este artigo analisou o padrão de especialização e localização do Valor Bruto da Produção (VBP) dos produtos madeireiros nativos nas microrregiões da Paraíba de 1994 a 2017. A coleta de dados realizou-se a partir das informações disponíveis da Produção da Extração Vegetal e da Silvicultura (PEVS) do Instituto Brasileiro de Geografia e Estatística (IBGE). Os indicadores empregados foram: o quociente locacional (QL), o coeficiente locacional (CL), o coeficiente de redistribuição (CRED), o coeficiente de associação geográfica (Cag), o coeficiente de especialização (CE) e o coeficiente de reestruturação (Cr). Os resultados evidenciaram que a lenha foi o principal produto madeireiro extraído nas microrregiões da Paraíba; apenas a microrregião do Serra de Teixeira apresentou relevância na extração de madeira em tora; a lenha foi o produto madeireiro que apresentou maior redistribuição; nos anos finais da análise as microrregiões do Litoral Norte e do Cariri Ocidental foram as mais especializadas, com ênfase na extração de lenha e as microrregiões do Litoral Norte, Cariri Ocidental, João Pessoa e Litoral Sul foram as que apresentaram maior mudança no padrão de extração dos produtos madeireiros com relação a 1994. A partir deste estudo é possível a orientação de políticas públicas que promovam o extrativismo vegetal de forma renovável para o suprimento da demanda energética e que possibilite o desenvolvimento de regiões.

Abstract This article analyzed the pattern of the Gross Value Production (VBP) specialization and location of native wood products in Paraíba’s microregions, from 1994 to 2017. The data collection was carried out from the available information of the Production of Plant Extraction and Silviculture (PEVS) of the Brazilian Institute of Geography and Statistics (IBGE). The indicators used were the locational quotient (QL), the locational coefficient (CL), the redistribution coefficient (CRED), the geographic association coefficient (Cag), the specialization coefficient (CE) and the restructuring coefficient (Cr). The results showed that firewood was the main wood product extracted in Paraíba’s microregions; only the microregion of Serra de Teixeira presented relevance in the extraction of wood in log; wood was the logging product that presented the greatest redistribution; in the final years of the analysis, the micro-regions of Litoal Norteand Cariri Ocidental were the most specialized, with emphasis on the extraction of firewood and the microregions of the Litoral Norte, Cariri Ocidental, João Pessoa and Litoral Sul were the ones that presented the greatest change in the extraction pattern of the products in relation to 1994. From this study, it is possible to guide public policies that promote renewable plant extraction to supply the energy demand and enable the development of regions.

Abstract Forest replacement is a public policy consisting of a set of measures that ensure the continuity of forest raw material supply to the consumers of native species. It is currently required through Art. 33 of the Federal Law 12,651/2012. Thus, this study aimed to characterize the main legislations and facts related to the forest replacement policy, addressing their responsible bodies and indicating their contributions to the forest sector, based on an extensive bibliographical and documentary research. Three federal bodies stood out as being responsible for such policy: INP, IBDF, and Ibama; being the responsibility of the third one shared with similar state agencies. The planted area was significant, especially during the period in which the IBDF was the responsible body, due to its encouraging performance and the incentives in force. We observed there are still problems related to transparency and implementation effectiveness due to the lack of joint actions between stakeholders and the incipient technical assistance.

Resumo A Lei de Proteção da Vegetação Nativa (Lei nº 12.651/2012) trouxe uma flexibilidade relacionada ao dimensionamento de Áreas de Preservação Permanente (APPs) ao longo dos cursos d'água em razão de ocupação antrópica preexistente a 22 de julho de 2008 (área rural consolidada), que pode variar de acordo com o tamanho do imóvel rural. Para melhor compreender os efeitos dessa lei, analisamos o uso e a ocupação da terra em APPs ao longo de cursos d'água em uma porção da bacia do Rio Grande. Também elaboramos cenários para comparar os efeitos da redução de limites de APPs, discutindo medidas para evitar degradação da água. Extraímos a rede de drenagem e individualizamos a área de estudo com auxílio de imagens disponíveis no Google EarthTM, e extraímos informações sobre o uso e ocupação da terra a partir de um vetor fornecido pelo Laboratório de Estudos e Projetos em Manejo Florestal da Universidade Federal de Lavras. Os cenários de recuperação foram estimados de acordo com o artigo n. 61-A da Lei de Proteção da Vegetação Nativa. Houve redução significativa do passivo ambiental em comparação com a legislação anterior. No cenário mais restritivo, pode haver um déficit de 31% nas áreas de recuperação, onde as bacias com forte presença de pequenos imóveis rurais serão as mais afetadas. Embora a redução das áreas de recuperação seja caracterizada como um retrocesso na proteção da vegetação nativa, estratégias complementares podem ser implementadas, como mecanismos de incentivo econômico.

Abstract Brazilian Native Vegetation Protection Law (Law n. 12.651/2012) brought flexibility related to the sizing of Permanent Preservation Areas (PPAs) along watercourses when there was anthropogenic occupation before July 22, 2008 (consolidated rural area), which may vary according to the size of the property. To better understand the effects of this law, we analyzed land use and land occupation in PPAs along watercourses in a portion of Grande River drainage basin. Scenarios were also developed to compare the effects of the reduction of PPA limits, allowing us to discuss measures to avoid water quality deterioration. We obtained the drainage network and individualized the study area through images available in Google Earth TM, and we extracted information about land use and land occupation from a vector provided by the Laboratory of Studies and Projects in Forest Management from Federal University of Lavras. Recovery scenarios were estimated according to Article n. 61-A from the Native Vegetation Protection Law. There was a significant reduction of environmental liability compared to previous legislation. In the more restrictive scenario, there may be a 31% deficit in recovery areas, where watersheds with a strong presence of small rural properties will be the most affected. Although the reduction of recovery areas is characterized as a retrogression in the protection of native vegetation, complementary strategies could be implemented, such as economic incentive mechanisms.

RESUMO A avaliação de impactos ambientais, introduzida por meio da Política Nacional de Meio Ambiente (PNMA), ganhou espaço primordialmente dentro do licenciamento ambiental, cujo modelo atual é questionado pela sua ineficácia em compensar ao ambiente a perda dos recursos naturais. Este estudo teve como objetivo analisar de forma técnica e legal o licenciamento ambiental minerário na Região do Alto São Francisco, Minas Gerais, por intermédio do histórico e fluxo atual dos processos, do levantamento de dados dos de Estudos de Impacto Ambiental, do cumprimento dos Termos de Referência e da legislação ambiental, analisando estes dados pelo método Analytic Hierarchy Process (AHP). Os resultados demonstraram que o licenciamento ambiental não cumpre a função de compensar os impactos socioambientais causados pela atividade nem os requisitos legais obrigatórios ao processo.

ABSTRACT The assessment of environmental impacts, introduced by the National Environmental Policy, has earned a place within the environmental licensing process, which is currently questioned due to its ineffectiveness to compensate nature for resources’ loss. This study aimed at technically and legally assessing the mineral environmental licensing process in the Region of Alto São Francisco, Minas Gerais, through history and current flow of processes, as well as by surveying data from Studies on Environmental Impact, and compliance with the Terms of Reference and applicable environmental law, using the Analytic Hierarchy Process (AHP). The results showed that the environmental licensing process does not meet the needs for compensating the socioenvironmental impacts caused by activity and does not comply with the legal requirements that are mandatory in the process.

ABSTRACT The conservation of natural resources within rural properties is a constitutional obligation. Among the social function criteria required for the exploitation of rural properties, besides the rational use and respect of working conditions, there is a need to ensure environmental protection. The current guidelines regarding the exploration and the environmental adequacy of the rural property are in the Native Vegetation Protection Law (NVPL - Law no. 12,651/2012) also known as Forest Code of 2012. This study aims to analyze different aspects of the Brazilian forestry legislation, with emphasis on the main points of the new legislation regarding the use and conservation of rural properties, highlighting the Rural Environmental Registry replacing the old model of Legal Reserve Registration. It is an update of the article “Ambient protection areas inside rural properties: the APP and RL case” published by Floram in 2011.

RESUMO Este artigo analisou a disparidade do valor bruto de produção dos produtos madeireiros do extrativismo vegetal das mesorregiões da Paraíba, Brasil, no período de 1994 a 2017. Os indicadores empregados foram: o quociente locacional (QL), o coeficiente locacional (CL), o coeficiente de redistribuição (CRED), o coeficiente de associação geográfica (Cag), o coeficiente de especialização (CE) e o coeficiente de reestruturação (Cr). Os resultados apontaram que a lenha foi o principal produto madeireiro e a mesorregião Sertão paraibano maior relevância, elevando a disparidade entre as regiões; o CRED apontou maior mudança para o carvão vegetal; a Mata Paraibana foi mais especializada em lenha e a mesorregião da Borborema apresentou a maior reestruturação em todos os períodos estudados. O estudo evidenciou que o VBP dos produtos madeireiros nativos ocorreu, principalmente, nas regiões mais áridas do estado para atender a demanda energética local e circunvizinha, com destaque aos segmentos de cerâmica vermelha e gesso.

ABSTRACT This paper analyzed the disparity in the gross production value of timber products from the state of Paraíba, Brazil, between 1994 and 2017. The indicators used were: the locational quotient (Lq), the coefficient of location (Cl), the coefficient of redistribution (Cred), the coefficient of geographic association (Cga), the coefficient of specialization (Cs) and the coefficient of restructuring (Cr). The results obtained indicated that wood was the main timber product extracted in the state of Paraíba, with the Sertão paraibano region being of greater relevance, increasing the disparity between the regions; the Cred pointed out greater change for charcoal extraction; the Mata Paraibana region was the most specialized region, especially for wood extraction; and the Borborema region presented the greatest restructuring in all studied periods. The study evidenced that the extraction of wood products mainly occurred in the more arid regions of the state with the purpose of population subsistence or industrial use, especially in the red ceramics and plaster segments for which wood can be used to generate heat and thermoelectric power.

RESUMO O carvão vegetal tem uma importância econômica, social e ambiental, pois além de fonte de energia, gera emprego e renda no meio rural. Portanto, conhecer o seu mercado é fundamental para as tomadas de decisões daqueles segmentos que dependem desta matéria prima. Este trabalho analisou a concentração regional da produção de carvão vegetal no estado da Paraíba, Brasil, no período de 1994 a 2016. Os dados empregados para mensurar a concentração regional da produção (em toneladas) do carvão vegetal nativo da Paraíba foram obtidos no Instituto Brasileiro de Geografia e Estatística (IBGE), no período de 1994 a 2016. Os indicadores utilizados foram a Razão de Concentração [CR(k)], o Índice de Herfindahl-Hirschman (HHI), o índice de entropia de Theil (E) e o Índice de Gini (G). Os principais resultados mostram que as mesorregiões da Borborema e do Sertão Paraibano se concentram a produção de carvão vegetal da Paraíba. O CR(k) dos municípios teve concentração baixa a moderadamente baixa e para as microrregiões uma concentração moderadamente alto a alto; o HHI e E mostraram tendências de desconcentração apresentando de mercados competitivos; o G mostrou em média uma desigualdade forte a muito forte para os municípios e microrregiões. Conclui-se que a concentração da produção do carvão vegetal nos níveis regionais não é concentrada, mesmo apresentando concentração moderada nos índices parciais [CR(k)] para as microrregiões da Paraíba.

ABSTRACT Charcoal has an economic, social and environmental importance, because in addition to being a source of energy, it generates employment and income in the rural environment. Therefore, knowing your market is fundamental for the decision-making of those segments that depend on this raw material. This work analyzed the regional concentration of charcoal production in the state of Paraíba, Brazil, from 1994 to 2016. The data used to measure the regional production concentration (in tons) of native Paraíba charcoal were obtained from the Brazilian Institute of Geography and Statistics (IBGE) from 1994 to 2016. The indicators used were the Concentration Ratio [CR(k)], the Herfindahl-Hirschman Index (HHI), Theil's entropy index (E) and the Gini Index (G). The main results show that the mesorregions of Borborema and Sertão Paraibano present concentrations in charcoal production from Paraíba. The CR(k) of the municipalities had a low to moderately low concentration and a moderately high to a high concentration for the microregions; the HHI and E showed deconcentration tendencies from competitive markets; the G showed strong to very strong inequality for the municipalities and microregions on average. It is concluded that the concentration of charcoal production at regional levels is not concentrated, even though it presents a moderate concentration in the partial indices [CR(k)] for the Paraíba microregions.

Resumo A questão central da investigação está em perceber as diferentes formas, relações e sistemas de imposto sobre a propriedade da terra urbana e a repercussão na organização política, econômica e social do Município de São Paulo (MSP) e da Cidade de Nova Iorque (NYC) entre 2000 e 2015. A partir das especificidades da execução da política fiscal, observam-se quais são os espaços, organizações, coalizões e interesses advindos das configurações da dinâmica política e imobiliária. Dessa forma, consideramos algumas instituições, estratégias e movimentos interessados na produção e uso da propriedade imobiliária (moradia, direito à renda e valorização da riqueza), no bojo da política pública, fiscal e urbana das cidades. A investigação reflete sobre alguns dos determinantes da diferença fiscal do tributo sobre a propriedade da terra, no que diz respeito aos padrões de relação entre os agentes e instituições que estabelecem específicas dinâmicas de produção, uso e apropriação do espaço social.

Abstract The central question of this investigation is to perceive the different forms, relationships and systems of tax on the ownership of the urban land and the repercussions on the political, economic and social organization of the Municipality of São Paulo (MSP) and of the City of New York (NYC) between 2000 and 2015. From the specificities of implementing fiscal policy, it is possible to observe the spaces, organizations, coalitions and interests that arise from the configuration of political and real estate dynamics. Thus, we consider some of the institutions, strategies and movements that are interested in the production and use of real estate (housing, right to income and wealth valorization), within the context of public, fiscal and urban policies for cities. The research reflects on some of the determinants of the fiscal differences between the taxation on land ownership, with regard to the relationship patterns between the agents and institutions that establish the specific dynamics of production, use and appropriation of social space.

ABSTRACT This research aims to identify the vulnerabilities of Rio Grande basin in Minas Gerais state as well as to investigate, through technical, legal, social, and governmental aspects, the relevance of SEA as an environmental tool for the conservation and preservation of watersheds. Rio Grande basin evaluation was performed by using this following database: soil classes, land use classification, water quality index, and economic ecological index. It was performed multi-criteria decision analysis based on analytic hierarchy process methodology. 52.5% of the studied area was classified as “good” preservation condition. Alto Grande (GD1), Mortes/Jacaré (GD2) and Furnas (GD3) units did not contain significant percentages of their areas corresponding to the preservation class “very good”. In the studied area, 34.51% was classified as “medium” preservation condition, thus indicating the need for effective measures for the river basin conservation. These findings highlight the potential importance of including the SEA in the decision-making process for plans, policies and programs related to the integrated management of water resources.

ABSTRACT The Brazilian Forestry Code established the Permanent Preservation Areas (PPAs) to preserve environmentally significant areas, such as the banks of waterways. Grande River is an important Brazilian river whose watercourse contains several hydroelectric plants, with few PPAs containing original features. Thus, this study analyzed land use in PPAs of a non-dammed stretch of the upper Rio Grande, in southern Minas Gerais. For this analysis, we used an image of the Rapideye sensor and the Maximum Likelihood classification method. The results showed the occurrence of pastures (49.63%), exposed soil (9.13%), others (0.77%), water (0.15%) and ornamental vegetation (0.13%) while the remaining native vegetation represented only 40.19% of PPAs. These numbers show that environmental laws have not been fulfilled in this area and there is strong human intervention in the PPAs studied.

RESUMO Licenciamento ambiental é a ação que define sobre a possibilidade ou não de implantação de determinada obra ou empreendimento. Este termo foi introduzido pela Política Nacional de Meio Ambiente, em 1981 e, desde o começo, incorporou a si a avaliação de impactos ambientais. O licenciamento ambiental em Minas Gerais se destacou pelo pioneirismo em inserir a discussão pública através do Conselho de Política Ambiental, na votação das licenças ambientais. Entretanto, este modelo participativo foi fragilizado com a aprovação da Lei Estadual 21.972/2016. Objetivou-se, neste artigo, descrever o processo de licenciamento ambiental em Minas Gerais, através de pesquisa exploratória bibliográfica e documental, expondo o histórico, modelo atual e as alterações inseridas com a aprovação desta lei. O modelo tradicional de licenciamento ambiental da década de 80 passou por períodos diferentes de implantação, consolidação, questionamentos e reconstrução, ou talvez, desconstrução.

ABSTRACT Environmental licensing is the action that defines the possibility of implementing certain construction or enterprise. This term was introduced by the Environmental National Policy, in 1981, and, since its beginning, it incorporated into itself the evaluation of environmental impacts. Environmental licensing in Minas Gerais, Brazil, pioneer in inserting the public discussion by means of the Environmental Policy Council, in voting on environmental licenses. However, this participatory model was made fragile with the approval of State Law no 21,972/16. With this article, we aimed at describing the process for environmental licensing in Minas Gerais, by means of a bibliographical and documental exploratory research, exposing the history, current model and changes inserted with the approval of this law. The traditional model of environmental licensing in the 1980’s has undergone different implementation, consolidation, questioning and reconstruction, or even deconstruction, periods.

RESUMO A grande expectativa acerca do Novo Código Florestal consistiu-se em reduzir as distorções da hermenêutica e aumentar a segurança jurídica dos produtores rurais. Contudo, a nova legislação suscitou mais incertezas e discussões, principalmente, ao consolidar o uso antrópico e a permissão de atividades de baixo impacto ambiental em áreas que deveriam, por lei, ser mantidas intocadas. Este trabalho teve como objetivo levantar e descrever a legislação relacionada às áreas de proteção na propriedade rural (APP e RL), analisar as formas de uso-ocupação consolidados e de baixo impacto que podem ser desenvolvidos nestas áreas, bem como, propor soluções técnicas sustentáveis para intervenções nas áreas já consolidadas e recuperação das mesmas. O Sistema Agroflorestal constitui uma alternativa estratégica de intervenção e recuperação das APPs e RLs àqueles pequenos produtores que ainda não estão em conformidade com a Lei. As propriedades rurais devem sempre procurar inovar, diminuindo custos de produção e aumentando a lucratividade com responsabilidade ambiental e o sistema agroflorestal tem-se mostrado uma alternativa que congrega produção com proteção ambiental.

ABSTRACT The great expectation about the New Forest Code consisted in reducing the hermeneutics distortions and increasing legal certainty for farmers. However, the new legislation raised more uncertainties and discussions, mainly because it consolidates the anthropic use and allows of low-impact activities in areas that should, by law, be kept untouched. This study aimed to survey and to describe the legislation related to protected areas on the rural area (APP and RL), to analyze the consolidated forms of use, occupation and low impact activities that can be developed in these areas, and to propose sustainable technical alternatives for interventions in the areas already consolidated and their recovery. The text is based on literature and documents, elaborated on the survey and study of legal aspects about protected areas in rural properties of Brazil and the main low-impact farming techniques, highlighting the agroforestry systems as an alternative of consolidated occupations in environmental protection areas. The text provides in an organized way the main aspects of the legislation on such areas and describes the sustainable activities allowed in APP and RL according to the flexibility of the new Forest Code.
